			<content:encoded><![CDATA[<p>I recently contracted Deerwalk, based in Lexington, MA (http://www.deerwalk.com) after a series of recommendations from friends and mentors. They were to help me develop an initial concept through wire framing and then converge on a detailed specification for development. Unfortunately shortly thereafter my market research had determined that the concept would not be viable so I asked Deerwalk to stop work and let me focus on my next concept. After another 2 months of market research I was ready to re-engage with them and in fact asked them for initial estimates to build a prototype. They confirmed that I still had $2000 in consulting and were ready to hear my new direction. This was after a week of no response from them due to vacation issues on their end.</p>
<p>Consulting with my advisors they recommended I adopt the lean startup method instead of building anything at this point so I re-engaged with Deerwalk and asked for my money back. Keep in mind at this point Deerwalk had $2000 in their accounts over the last 2 months. I had then discussed with them refunding the ENTIRE amount for which they agreed. Ironically enough I felt good that they were saying the right things.. we are here to help and when you are ready we will be ready to work with you again and their new CTO even offered to stay in touch. Wow!</p>
<p>A few days later I got a call from their sales representative and he said he was mistaken in promising me a full refund and that they would have to charge me for time that was spent on the project. I agreed that they had spent time on wire framing and had no problem paying for it. </p>
<p>Well it turns out that when I got the refund they had also charged me for doing research on whether they would be capable (in terms of domain expertise) of implementing my new concept with no evidence or documentation other than an excel spreadsheet showing me the itemized list of charges.</p>
<p> In fact I have yet to receive a detailed report of their findings or analysis. </p>
<p>So at the end of the day they refunded me $1200 and I believe I owed them no more than $200:</p>
<p>$2000 Deposit<br />
-$200 Wireframing<br />
-$600 (Research?)<br />
&#8212;&#8212;-<br />
$1200 Refund</p>
<p>Deerwalk subtracted an additional $600 which I never agreed or authorized for them to do. When I asked about the research they were going to send me their report and as of today I have not received any reports.  My recommendation would be to look elsewhere.</p>

<p> I was in the process of trying to arrange for a night out for my team to watch the Celtics play the Pistons on 12/19 and unfortunately ran into http://www.ticketsmyway.com. On 11/12 I was trying to order 8 tickets for the game and found www.ticketsmyway.com, got an online confirmation for the 8 total tickets and entered in my credit card and a few days later on 11/20 I got three separate Fedex envelopes. On 11/21 I finally had a chance to open the envelopes and to my dismay I got only 6 tickets. I contacted them on two occasions via e-mail (details below) on 11/21 as well as left a voice-mail on their main support line with the issues. They had charged my over $298 for handling fees and an extra $34.00 to ship my tickets in two separate envelopes and decided to make up the difference by removing two tickets! I&#8217;ve started a case with Bank of America with all the supporting documentation as well as filed cases with the online fraud unit of the FBI and the local Nevada BBB. Connection Fee = $157<br />
Shipping = $17</p>
<p>Discount = -$21<br />
Total Cost (Includes shipping and fees) = $1210</p>
<p>2. I get invoices from you (4563,4562, 4561) that break down like this:</p>
<p>4561:<br />
Loge 3, Row 7, 3 Tickets $137 / each = 411 + 17 Shipping + 100 Handling = $527</p>
<p>4562:<br />
Loge 3, Row 11, 2 Tickets $127 / each = 254 + 17 Shipping + 100 Handling = $370</p>

<p>The issues I have are:<br />
You have short changed me two tickets in Loge 4, Row 25 which I still need by the way&#8230;<br />
You have charged me $300 in handling fees when it should be $157 and an additional $34 in shipping fees when it should be $17<br />

<p>After two full days I have not heard a peep from them. Unfortunately for me I checked the local BBB and they have over 16 complaints and many other users claiming fraudelent tickets. I have taken this up as a dispute with my credit card company but I figure I would save others their time and money dealing with these guys.  This company also has profiles on ebay and myspace so watch out.</p>

I suck&#8230; but I said to myself that day when I borrowed the club as a loaner that if this thing straightened out my drive and I broke the 100 barrier I would buy it.. I finally found one at a reasonable price&#8230; I went out again and played another round.. and guess what.. with my crappy swing I broke the graphite shaft&#8230; I called Callaway and talked to the customer service rep&#8230; they apologized.. paid for me to ship the broken club out to them.. they re-shafted the club and sent it right back&#8230; AWESOME!!  I&#8217;ll comment again on the club itself once I get back out again.. who knows with global warming I maybe able to book some tee time in the next couple of weeks&#8230;</p>

			<content:encoded><![CDATA[<p>Not that this is news to anyone but I have been saved so many times by my Valentine 1 radar detector I should pay them a monthly subscription fee for saving my butt&#8230;. until recently with the advent of the laser guns here in Massachusetts.. there have been multiple incidences where the guy I was drafting got caught while I slowed down a mile or two before the radar gun hit me. Here are some specific examples of some of the patent features that have saved me a ticket and more importantly higher insurance:</p>
<p>1. Arrows: A dodge intrepid that is heavily tinted is bobbing and weaving through traffic and the V1 detector arrows point to him going around me so I quickly slow down thinking just to be safe this guy either has a cheap radar detector that trips my V1 or he is a cop.. lo and behold.. he pulls the guy that sped past me as I pulled over from the left lane&#8230; ouch&#8230;</p>
<p>2. # of Radar: While driving past the local supermarket the V1 is alarming me about 2 signals versus the typical 1 for the automatic doors.. again I slow down with plenty of time to notice the sneaky cop sitting in the parking lot with his radar gun to save myself another ticket&#8230; </p>
<p>If you drive and tend to be a little lead footed.. go get a V1..</p>

			<content:encoded><![CDATA[<p>I wanted to capture this story for posterity since I remember how little me and my wife (then girlfriend) felt when one day we had finished shopping at the Copley Place Mall in Boston and decided to check out the newly renovated lobby of the Boston Copley Westin Hotel. There were other folks in the lobby and we had sat there for about 10-15 minutes when security came up to us and asked if we were guests. My wife in a knee jerk reaction said that we were and &#8220;rent-a-cop&#8221; asked what room were we staying in and could we show him the keys to our room. I of course started to ask him questions.. do we have to be guests to stay in our lobby&#8230; what if I was thinking of an event at the hotel and I wanted to check out the lobby&#8230; and all he kept saying was that it was hotel policy not to let anyone but hotel paying guests stay in the lobby&#8230; this is the lobby&#8230; not a private function room, not a hallway inside the hotel but the front lobby&#8230; it didn&#8217;t stop there.. he started to harass others and one gentlemen who was also sitting with us was visibly upset and threatened a discrimination lawsuit&#8230; I just calmly asked for the &#8220;rent-a-cop&#8217;s&#8221; name, noted the date and time and made notes about our experience and decided to write a letter&#8230; to the CEO of Westin Hotels&#8230; of course I did my research and highlighted their &#8220;Core&#8221; values and that I regularly made recommendations to our travel department on where the company should book our accommodations.. I figure what the heck&#8230; a few months later.. I got a call at home and it was Mr. Rent-A-Cop&#8230; he was calling to personally apologize for that day and offered me a stay at any Westin on HIS EMPLOYEE DISCOUNT.. I didn&#8217;t take him up on the employee discount but hearing him apologize was well worth it&#8230; it is scary that some people just don&#8217;t get customer service.. I&#8217;ve been in the customer service industry in various forms for over 20 years.. and you can&#8217;t please everyone but you can at least try!.. I hope he learned his lesson&#8230;</p>

			<content:encoded><![CDATA[<p>On September 22nd we had purchased a toy and a 9v battery for our daughter at the local Radio Shack using a gift credit we got from last X-Mas. We still had a few dollars left and began to realize I needed a good Skype ready headset for working with folks overseas and decided to go back to the store on October 21 to return the batter and use the rest of the credit to get the headset (which by the way was 1/2 off with a rebate form). I let my wife go in thinking, who would refuse a 9 month pregnant lady a return of an item which was unopened and we also still had the original receipt. Boy was I WRONG!! After waiting in the car with my screaming 2 year old daughter for what seemed like an eternity, I finally went into the store and asked what was going on. My wife, visibly upset was saying that &#8220;Stan&#8221; refused to give us credit for the 9V battery because it was bought with a gift card&#8230;. WHAT??? I asked to talk to the manager and he said &#8220;Sammy&#8221; would not be around until tomorrow. He said he would get in trouble for giving us credit for the battery and letting us apply it to the headset. This was after my wife told me that &#8220;Stan&#8221; had told another customer that he could lose his job by opening up a brand new cell phone and allowing another customer to exchange it for his used one. My wife of course kept calling him out on it&#8230; he was a little uneasy&#8230; </p>
<p>Well a week later I filed a complaint with our local BBB as well as contacted Radio Shack via there web-site and today my wife walked in and returned the battery&#8230; we&#8217;ll see what happens with the BBB complaint.. I asked for a formal letter of apology, 20% off my next purchase, and a full refund (which I already got)&#8230; </p>
<p>Lucky for &#8220;Stan&#8221; he was not there&#8230; I&#8217;m still tempted to go there and ask Stan if he knows what the return policy is&#8230;</p>

			<content:encoded><![CDATA[<p>It all started with a posting for a project on http://www.guru.com for a desktop widget on June 15th with a signed NDA for access to the details of the project. Mr. Winston (http://www.squeaky-bird.com/) seemed cordial and responsive so on June 18th we agreed to a contract that outlined the functionality for the widget and I paid him 50% of $875.00 as an initial deposit. (Lesson 1: Don&#8217;t pay software developers any money until they produce results, at most pay them 10% but after speaking to Guru they said NOT to pay for software development unless you have code). Here is a message he posted to me on Guru:</p>
<p>&#8220;I&#8217;m a professional programmer/web developer and managed various development companies for 5 years before recently starting my own IT consulting and software development company. I taught web application programming at two universities, and have a great deal of experience with developing various applications.</p>
<p>I have developed desktop widgets for Windows and Linux for a proprietary gaming application. I have worked with the Google sdk for 3 years, and though I haven&#8217;t completed a Google gadget, have a great deal of familiarity with the tools and the process for doing so.</p>
<p>I&#8217;d be happy to discuss this project with you further. Please contact me at (210) 632-2125, swinston@squeaky-bird.com or anderjl101@hotmail.com.&#8221;</p>
<p>What a joke! It should read.. I have stolen from many people through Guru.com and have yet to show any of the capabilities I have claimed above&#8230; back to my story&#8230;</p>
<p>So finally after the deadline passes and he DOES NOT send me anything including a mock-up or prototype for review I start to engage him and work with him on many nights waiting for a drop (sometimes until 2-3am) with no results. I spent a significant amount of time chasing him until finally his voice-mail was full and on one instance he actually had the gall to tell me he couldn&#8217;t talk to me because he was actually working on another proposal. This was after 4 more weeks of no prototype, no code snippets, not even a desktop snapshot of my widget. Finally I was forced to give him negative feedback (http://www.guru.com/emp/company-viewProFeedback.cfm?g=tRcl%2ffo9vbBvYT16qRAKrQ%3d%3d), report him to the local BBB, as well as the internet crime division of the FBI. </p>
<p>During the next few weeks I have gotten numerous other users who have been cheated by Stealing Bird Consulting. Below are some of their comments:</p>
<p>&#8220;Hello, Yes we had some major issues with Steven Winston. I have asked guru.com to help get my money back. I just spoke to him today about refunding the money,  however I dont hold my breath. He was also suppose to develop a classroom /<br />
erecruiting / myspace type of system for our college. The demo he gave was  nothing but the basic drupal install with groups. Didnt even use the theme I gave him for our site.&#8221;</p>
<p>&#8220;I have paid Mr. Winston for a project and he is 6 months behind the deadline.  I have the same problems you mentioned on the GURU site.  Would you mind sharing any of your issues and how was it resolved?&#8221;</p>
<p>As I told him before.. for 472.50 he will lose business and will continue to do so. I have already &#8220;saved&#8221; one potential employer from hiring him and this page hopefully will save others.  I have included detailed and uneditted private message board posts from my correspondence with him so you can be the judge&#8230;</p>

<p>The partner that is the lawyer is the one that is suggesting we just go the take it to legal action route. We delivered products on time, and actual products were delivered and work was done.<br />
I&#8217;ll decide what to do soon. But I do have to state that the fact I&#8217;ve done all this work and am being faced with someone NOT doing ANYTHING on his end to be anything other than sneaky and to steal work from me.<br />
I have three options, one, enforce the project agreement and go the legal route, which you did agree to. Two, give you money which would be a waste in opinion as there is zero reason to trust you especially given the past few communications. Or three, continue business and explain to everyone why someone incompetent has left feedback that is not indicative of my work.</p>

<p>Take a look at the weather. You call an excuse something that has taken lives of over 23 people, all of which were within a 20 mile radius. I informed you of the weather and the electrical conditions. Due to your behavior, my partners are wanting to NOT refund your original 400$ and take you to small claims court for the entirety of the money that is owed us under the contract (given hours worked on your project it&#8217;s more than the $800 total).<br />

As I&#8217;m honest, I refunded your portion of money that was in escrow, despite how amazingly poor your review was and how inconsistantly untruthful. We will NOT refund the rest of the money until we have a way to remove the review which was NOT earned. Despite your ability to understand how your product worked, you received a prototype ontime, and you received updates.<br />
I put up with your attacks on me only to go through time again stating that I didn&#8217;t deliver when I did many times over.<br />

<p>Ebay is now working against the sandbox version of ebay. It&#8217;s part of ebay&#8217;s developer program. To see what the sandbox looks like http://sandbox.ebay.com. When I get this program through their validation phase, it will be able to point to the normal ebay site and pull real results. I have to wait until tomorrow to do this as no one at Ebay is going to be awake right now. Despite it being automated, I&#8217;ve never taken a program of theirs to the live site without needing human intervention. Attached are the three screen shots for the zipfive<br />
google gadget. The user should be able to specify in<br />
the options list their zip code and either three<br />
different ways to search:</p>
<p>1. Keywords - which they can specify in the options.<br />
Multiple keywords can be entered and the gadget will<br />
create a stack of listings based on the most recent<br />
postings or expiring listing posted. If it is ebay<br />
the user may specify either showing only new listings<br />
or listings ending first. For craigslist is would<br />
probably make sense to only show the most recent or<br />
newest postings.</p>
<p>2. Categories - the user may just want to monitor a<br />
category and watch for items locally so the same rule<br />
applies as above except items will show up as they<br />
appear new or expiring in ebay and only new listings<br />
in craigslist.</p>
<p>3. MyFive - will allow registered users to save their<br />
searches and refine their searches by using keywords<br />
and categories.</p>

<p>It would be a different application entirely, so unfortunately I wouldn&#8217;t be able to do it as part of this current contract; but we can do a seperate project for you that does work on mobile phones. See your project isn&#8217;t written in J2ME which is the language of choice for cell phones. <p>Can you change ThingTeq LLC to just Robert Yu&#8230; and you should adjust the dates to start 6/20 so that you have sometime for the initial payment to clear. Otherwise things look good.</p>
